These combined Terms of Use, Privacy Policy, and Liability Waiver govern your use of our website, community spaces, applications, memberships, coaching services, and all related platforms (collectively, the “Services”).

By accessing or participating in any Artistically Mused Services—including workshops, memberships, downloads, online programs, events, classes, or challenges (“Artistically Mused Activities”)—you acknowledge that you have read, understood, and agreed to these terms.

3.9 Governing Law

These Terms are governed by the laws of the Province of Ontario, Canada, and federal Canadian laws. Disputes will be resolved in Ontario courts.

4. Liability Waiver – Coaching & Art Services

Please read carefully before participating. By booking or participating, you agree:

Nature of Services
Services—including 1:1 Art Companion, Creative Coaching, and Group Zoom sessions—are for personal, creative, coaching and educational purposes only. They are not a substitute for medical, mental health, or professional advice.
Assumption of Risk
Participation in any creative activity involves personal judgment and effort. You voluntarily assume all risks.
No Guarantees
Artistically Mused, Cozy Muse Studio, and Lauralea Eldridge do not guarantee specific outcomes or results.
Release of Liability
You release, waive, and hold harmless Artistically Mused / Cozy Muse Studio, Lauralea Eldridge, and all employees, contractors, or agents from any claims, liabilities, or damages arising from participation.

This release extends indefinitely to any and all relations, family members, heirs, estate, or descendants, now or in the future.

Confidentiality
We are not liable for information voluntarily shared during sessions. Participants should exercise discretion.

5. Amendments

Artistically Mused reserves the right to modify these Terms, Privacy Policy, or Liability Waiver at any time. Continued use constitutes acceptance of updated terms.

The Artistically Mused Website, Social Media Pages, and Membership Programs (collectively, “Platforms”) and all content, artwork, and materials provided through them (“Content”) are owned by Artistically Mused, operating in Canada. The term “you” refers to any user, member, or viewer of these Platforms.

By accessing or participating in any Artistically Mused activities, including workshops, memberships, downloads, online programs, events, classes, or challenges (collectively, “Artistically Mused Activities”), you acknowledge and agree to comply with these Terms.

If you do not agree, please refrain from using our Platforms or Content.

Eligibility

The Platforms and Content are intended for individuals aged 18 and over. Artistically Mused disclaims responsibility for any use by individuals under 18.

Payment and Refund Policy

By providing a debit or credit card, you authorize Artistically Mused to automatically charge for all purchases, subscriptions, or membership fees. You will receive an electronic receipt for all transactions.

If payment is not received by the due date, you will have a 3-day grace period to make payment before your access to membership content or services is suspended.

Because of the care and time that go into creating our materials, all sales are final. No refunds will be provided unless otherwise required by Canadian law.

If a chargeback or payment dispute is initiated without contacting us first, we reserve the right to suspend your membership and report the incident to relevant financial or fraud databases.

Ownership and Intellectual Property

All designs, graphics, written materials, videos, and other creative content found on Artistically Mused’s Platforms are the property of Artistically Mused and are protected under Canadian and international copyright and trademark laws.

You are granted a personal, limited, non-transferable, non-commercial license to access and view the Content for your personal enjoyment and education only.

You may not reproduce, copy, resell, share, or distribute any part of the Content without written permission. Unauthorized use may result in immediate termination of access and possible legal action.

Your Contributions and Submissions

By submitting comments, posts, photos, videos, or other materials (“Contributions”) to any Artistically Mused Platform, you confirm that:

You are the owner of the material or have permission to post it.
You grant Artistically Mused a non-exclusive, royalty-free, perpetual, worldwide license to use, modify, share, or display your Contributions in connection with its business or marketing activities.
You consent to the use of your name, likeness, or comments for promotional purposes without additional compensation.

Community Conduct

Artistically Mused is a positive and supportive community. We ask all members to act with kindness and respect.

You may not:

Harass, abuse, or intimidate others.
Post or share offensive, defamatory, or unlawful content.
Promote unrelated products, groups, or events without written consent.
Distribute spam, viruses, or harmful materials.
Misuse or share private member information.

Violation of these rules may result in immediate and permanent removal from the Platform without refund.

Username and Password

You are responsible for maintaining the confidentiality of your login information. Sharing your password or account access with others is strictly prohibited. If unauthorized activity is suspected, Artistically Mused may suspend or terminate your account.

Termination

Artistically Mused reserves the right to suspend or terminate access to its Platforms or Content at any time, without notice, if you breach these Terms or engage in inappropriate conduct.

Disclaimer and Limitation of Liability

Your participation in Artistically Mused programs and creative activities (such as painting, crafting, or art-making) may involve minor risks (e.g., use of art tools or materials). By participating, you assume full responsibility for your own safety and release Artistically Mused, its owners, affiliates, and team members from any liability for injury or loss.

All information and services are provided “as is” without warranties of any kind. Artistically Mused does not guarantee specific results, outcomes, or earnings from participation in any of its programs.

Artistically Mused is not responsible for any third-party content, websites, or services linked through our Platforms.

Governing Law

These Terms shall be governed by and interpreted in accordance with the laws of the Province of Ontario, Canada, and the federal laws of Canada applicable therein. You agree that any disputes shall be resolved in the courts of Ontario, Canada.

Indemnification

You agree to indemnify and hold harmless Artistically Mused, its directors, employees, and affiliates from any claims, damages, or expenses arising from your use of the Platforms, your breach of these Terms, or your violation of any law or third-party rights.
